By accessing or using EvalItUp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

EvalItUp is a trade copying software that allows users to replicate trades from a master trading account to multiple connected accounts. The Service is designed for use with proprietary trading firm evaluations and funded accounts.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration

You must provide accurate and complete information during registration
You are responsible for maintaining the security of your account credentials
You must notify us immediately of any unauthorized access to your account
One account per person; sharing accounts is prohibited

5. Subscription and Payments

5.1 Billing

Subscriptions are billed in advance on a monthly or annual basis. All payments are processed through Stripe. You agree to pay all fees associated with your subscription plan.

5.2 Free Trial

New users receive a 14-day free trial. No payment information is required to start the trial. At the end of the trial, you must subscribe to continue using the Service.

5.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5.4 Refunds

We offer a 30-day money-back guarantee for first-time subscribers. Contact support within 30 days of your first payment for a full refund.

6. Acceptable Use

You agree NOT to:

Use the Service for any illegal purpose
Violate the terms of service of any trading platform or prop firm
Reverse engineer, decompile, or disassemble the software
Share, resell, or sublicense your access to the Service
Attempt to gain unauthorized access to our systems
Use the Service to manipulate markets or engage in fraudulent trading
Circumvent any security measures or usage limits

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The Service is provided "AS IS" without warranties of any kind
We are not liable for any trading losses, missed trades, or execution errors
We are not liable for any indirect, incidental, or consequential damages
Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
We are not responsible for outages, delays, or failures caused by third parties (trading platforms, brokers, internet providers)

9. Intellectual Property

The Service, including its software, design, logos, and content, is owned by EvalItUp and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription period.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive (including limitations of liability and dispute resolution).

11. Indemnification

You agree to indemnify and hold harmless EvalItUp and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in [Location to be specified]. You waive any right to participate in a class action lawsuit.
